Transport minister of Delhi, Mr Gopal Rai on Wednesday wrote to the union road transport and highways minister Mr Nitin Gadkari on the issue of National Green Tribunal (NGT) order on 10 year and 15 year-old vehicles.
The contents of the letter are as follows :
Dear Nitin Gadkari ji,
As you are aware that Hon’ble National Green Tribunal has passed several orders in respect of air pollution in Delhi and NCR region from 26.11.2014 onwards. Vide these orders, Hon’ble Tribunal has passed the following directions.
- Ban on plying of 15 years old all motor vehicles and ban on plying of 10 years old all diesel vehicles on the roads of Delhi.
- Action against overladen vehicles
- Action against polluting vehicles.
- Installation of weigh in motion and to allow the entry of overladen vehicles in Delhi and NCR region.
In this regard, I am drawing your kind attention to the sub-section 10 of section 41 of Motor Vehicles Act, 1988 vide which the registering authority may, on receipt of an application under sub-section (8), renew the certificate of registration for a period of five years and intimate the fact to the original registering authority, if it is not the original registering authority. As regards transport vehicles, the Hon’ble Apex Court has fixed a maximum life of 15 years for NCT of Delhi, however, subject to respective permit conditions.
Since the above provisions are subject matter of the Motor Vehicle Act, 1988 and rules framed there under which is in domain of the Government of India, I request you to consider the matter as urgent for appropriate decision so as to facilitate the implementation of the orders of NGT.
In addition, it has been brought to my notice that National Highway Authority of India has undertaken the pilot projects in some Southern States like Karnataka and Maharashtra to install weigh in motion to identify overladen vehicles. May I request you to issue direction to NHAI for installation of weigh in motion on major highways from where the entry of trucks happens at very high frequency in territory of NCT of Delhi and entire NCR region.
To discuss these matters, I seek an urgent appointment at any convenient time so that NGT may be apprised of the action plan in correct perspective and in this meeting the Minister of Transport of the States of Haryana and Uttar Pradesh may also be invited.
